Aggravated Assault with Firearm
On December 7, 2010 at approximately 8:45 p.m., at the Westshore Pizza located at 5310 North Orient Road the suspect entered the business armed with a .40 caliber semi-automatic pistol. The suspect sat at a table having a slice of pizza and then made a conscious decision to rob the business. The suspect brandished the firearm, chambering a round into the gun and demanded the employee give him the money. A struggle ensued over the firearm as the suspect was taking the money from the register with the firearm discharging into the floor. During the struggle the employee was able to pull the suspect's sweatshirt off, which was left at the business. Inside the front pocket of the sweatshirt was the suspect’s identification and cell phone. The suspect returned home and called the Sheriff’s Office to report that he had been attacked by two suspects. Deputies responded to his residence and arrested the suspect. He was positively identified by the clerk.
