Deputy Depianta was on his way to a school crossing at Schwarzkopf Elementary School. He was traveling north on Florida avenue, he had a green light and was attempting to make a left on Bearss Avenue at the intersection, when he observed a homeless individual standing in the middle of the intersection. Deputy Depianta activated his blue lights, stopped and called to the homeless individual to get out of the intersection. The individual refused and the Deputy Depianta told him several times to get out of the intersection. At that time, the light changed to green for traffic on Bearss Avenue. A Toyota Tundra traveling east on Bearss Avenue was distracted by the homeless individual and struck Deputy Depianta’s motorcycle. Deputy Depianta suffered some road rash was transported to St. Joseph’s hospital to be medically cleared. The driver of the Tundra was not injured. When the traffic crash occurred, the homeless individual fled the scene on foot.
