    Teen Is Charged With Vehicular Homicide

    Bicyclist died as a result of his injuries.

    ****Update November 4, 2011****


    Lenoy Rivera, DOB 3-23-92 turned himself in at the Orient Road Jail on November 3, 2011 on charges of Vehicular Homicide and Driving While License Suspended.

    On February 13, 2011, the defendant (Lenoy Rivera) was operating a 2006 black Ford Five Hundred, traveling east bound on CR 582A from the area of 42nd street towards Interstate 75. The defendant, along with co-defendant, Armando Perez were witnessed exceeding the speed limit, passing each, passing other traffic, changing lanes abruptly, tailgating each other and tailgating other traffic as they traveled eastbound on CR582A, giving the witnesses the perception that both vehicles were racing. The Airbag Control Module from the defendant’s vehicle showed a maximum speed of 92 miles per hour just prior to the crash. The defendant lost control of his vehicle, striking a bicyclist , Robert Niedbalec, who was also traveling east bound within the designated bicycle lane. Niedbalec sustained fatal injuries and died at the scene. The above listed actions were a willful and wanton disregard fro the safety of persons and property, caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death, or great bodily harm to another. Rivera was also operating the vehicle while his Florida driver’s license was suspended. The defendant was identified by several witnesses as the person who exited the vehicle through the driver’s window.

    The investigation continues.

    Previous News Release (11-053) Details:

    On February 13, 2011 at 1:46 PM, a Ford Five Hundred driven by Cristina
    Perenzuela was traveling eastbound on Fletcher Ave. when she struck and killed Robert Niedbalec who was riding his bicycle eastbound on Fletcher Ave in the designated bicycle lane.

    Apparently the crash was a result of the Ford Five Hundred losing control while traveling at a high rate of speed in tandem with the 2001 Honda 4 door for at least 1/2 a mile and possibly further. It is still unclear if both vehicles were racing at the time of the crash.

    No charges have been filed pending further investigation.
