On November 21, 2012, the victim (adult female) and the defendant engaged in a verbal confrontation. Following the verbal confrontation the victim attempted to leave the residence at 4114 Berkley Drive when the defendant grabbed the victim by the hair and forced her into his bedroom. Once inside the bedroom, the defendant pounded the victim’s head against the floor and punched her in the face. The defendant then pointed a black handgun at the victim and threatened to kill her. The defendant then forced the victim onto the floor, stepped on her neck and kicked her in the face. The defendant restrained the victim in flex cuffs. After a period of time the defendant cut the flex cuffs off the victim and forced her to perform sexual acts. The victim suffered a broken nose in the attack as well the abuse.
On November 26, 2012, detectives served a search warrant at the residence of the defendant, Frankie Aguilar Jr. located at 4114 Berkley Drive in Tampa. The search warrant was for the recovery of the handgun used in the assault that occurred on November 21, 2012. The weapon was recovered. During the search 5 destructive devices were located inside of a secured office which only the defendant had access to via a key. Members of the HCSO Bomb squad responded and determined that the devices contained energetic and could be ignited via a fuse. Additionally, a white powder substance which tested positive for cocaine was located in the defendant’s bedroom with straws and a homemade pipe used to ingest same. Post Miranda the defendant admitted that the destructive devices had been in his home for approximately two (2) years, he had handled same and that they were designed to detonate.
During the search warrant, detectives also discovered several SD cards and found video of a sexual assault that had occurred.
The video that was discovered during the search warrant revealed another incident where the defendant lured another adult female victim into his bedroom at which time he ordered her to remove her clothing. When the victim did not completely submit to the defendant’s demands, he became physically violent. The defendant forced the victim onto his bed against her will and choked her. A struggle ensued with the defendant violently sexually assaulted the female and during the struggle the defendant tazed the victim no less than 5 times. The defendant then produced a pistol and held it to the victim’s head and threatened to kill her. The victim was held against her will for approximately one and one half hours. The defendant then threatened the victim if she went to law enforcement; he would kill one of her family members and make her watch as he did so. Detectives have identified the female and charged Aguilar with the assault.
Detectives also recovered the driver’s license of the two victims that have been identified and 4 other drivers licenses that detectives are attempting to locate.
