On June 17, 2012, at approximately 12:45 a.m. the co-defendant Pedro Hernandez, the victim Jose Hernandez and the defendant Jesse Robarte were traveling in a vehicle southbound on Lindsey Street just south of Bragg Street in Dover. Upon driving up to the residence of 3418 Lindsey Street, were a graduation party was being held with numerous people in attendance, the co-defendant Pedro Hernandez did fire his .40 caliber handgun multiple times, at the victim Jose Navarro and multiple other person’s that were attending the party.
During the commission of this offense, gunfire was returned by the victim Jose Navarro, and other persons, at which time the victim Jose Hernandez was fatally injured, by a gunshot wound to the back of his head.
During a recorded interview, under oath and post Miranda, the co-defendant Pedro Hernandez told detectives that he gave the small black .40 caliber firearm to the defendant Jesse Rodarte, after they abandoned the Cadillac in the area of Burchwood Park in Plant City.
During a recorded interview, under oath and post Miranda, the defendant Jesse Rodarte, admitted to accepting the small black .40 caliber firearm from the co-defendant Pedro Hernandez, at which time he tossed the firearm into a drainage ditch around the area of Burchwood Park. The defendant Jesse Rodarte agreed to show detectives the area where he disposed of the firearm, at which time he led detectives to the drainage ditch on the southwest corner of West Reynolds Street and Drake Street in Plant City. Upon inspection of the area, the firearm was not recovered.
On June 24, 2012, deputies developed information that the gun was in a pond in the area of North Oak Avenue East of Walter Drive in Plant City. On June 26, 2012 members of the Hillsborough County Sheriff’s Underwater Recovery Team conducted a dive and recovered a small black .40 caliber Glock firearm, which appeared to be in excellent condition and was sent to (FDLE) Florida Department of Law Enforcement for analysis.
