On May 15, 2012 at approximately 8:20 a.m. deputies Tabor, Fallin and Paes attempted to make contact with a suspicious person (defendant) at 1919 139th Avenue within Hillsborough County. The defendant was stopped because he matched the physical description and was wearing the same clothing as the suspect that had just been involved in a verbal altercation. The complainant provided a sworn statement that the defendant was involved in a verbal altercation and during the altercation; the defendant displayed a handgun in his waistband. The defendant fled the scene and was stopped by the deputies. Deputy Tabor asked the defendant if he was armed to which the defendant replied “No”. Deputy Tabor then attempted to conduct a weapons pat-down of the defendant at which time he began to flee on foot. The defendant armed himself with a .22 cal revolver, which was in his pocket and as he was beginning to flee, raised the handgun and fired the handgun at the deputies, one (1) time. At the time the defendant fired the weapon at the deputies, Deputy Paes was approximately 5-6 feet from the defendant. The defendant then dropped the gun and after a brief foot pursuit was taken into custody. Post-Miranda the defendant admitted to being possession of a firearm but not shooting the gun. A check revealed that the defendant was convicted as an out of state felon.

There were no injuries to any deputies.
