On September 5, 2013, a 3-year-old female had been experiencing vomiting and lethargy throughout the day. She had been in the care of Elisamuel Pacheco through out the date of 9/5/13 and previously throughout the week. The victim, along with her 9-month-old twin brothers, would remain in the care of the defendant while their mother worked. Per the mother and the defendant, the victim had been experiencing vomiting all week and they thought it was a virus. Between 6:00 p.m. and 7:00 p.m., the victim was discovered to be unresponsive by other family members within the home. The victim was transported to Florida Hospital by Hillsborough County Fire Rescue, after 911 was called. At 7:51 p.m., the victim was pronounced dead.
After a medical examination by the Hillsborough County Medical Examiner's Office, it was determined the victim had signs of sexual battery and internal injuries. The manner of death is ruled Homicide, beaten by other person(s).
On September 6, 2013, at approximately 6:00 p.m., Elisamuel Pacheco was taken into custody and charged with one count of First Degree Murder, one count of Capital Sexual Battery and one count of Aggravated Child Abuse.
