On 09/13/2009, the 3-month old victim suffered blunt impact to the head while in the sole care and custody of Travis Miller. The mother of the victim had left the residence after 6:00 pm to go to a friend’s home. The mother left the victim alone with the defendant. While she was away from the residence, the defendant was unpacking within the travel trailer they inhabited while the victim was secured in a baby bouncy seat. The defendant advised that the victim became unresponsive and stopped breathing while within the bouncy seat. The defendant immediately called the mother on her cell phone at approximately 7:16 pm and then called 911.
The victim was transported to St. Joseph’s Hospital PICU and later expired on 09/14/2009 as a result of the injury he incurred. According to The Hillsborough County Medical Examiners Office, the victim suffered blunt impact to the head with subdural hematoma and the onset of symptoms would have been within minutes. The defendant was in sole care and custody of his child, the victim, within the allotted time frame of injury to occur with the onset of symptoms, causing the victim to go into respiratory distress.
