    Details:

On July 10, 2015 at 3:29 p.m., detectives responded to 1932 Mobil Villa Drive S. in Lutz in reference to a residential burglary that just occurred. Information obtained revealed that a black male and a Hispanic male had burglarized the victim's residence and were observed walking away from the location of the incident carrying the victim's laptop computer along with burglary tools. Witnesses confronted the suspects after taking photographs of them, at which time the Hispanic male pulled out a gray/black semi-automatic handgun and pointed it at the three victims. The suspect then discharged five rounds into the air which caused the victims to flee as they were in fear for their lives. Additional deputies, Aviation and K9 Zeus responded to the incident scene. A perimeter was established and K9 Zeus picked up a track that led directly to the suspect's home at 6-2010 148th Avenue East in Lutz. The suspects came to the door and were identified as Neil Herron and Anthony Austin. All three victims positively identified the suspects as the ones that committed the criminal offenses of burglary and aggravated assault. The victim of the actual burglary responded to his residence and confirmed that his home had been burglarized and his Taurus semi automatic 40-caliber handgun had been stolen, along with electronic items and jewelry. Entry had been made into the residence by force as the front door had been pried open.

Detectives at the suspect's residence obtained a consent to search form from the owner of the home and conducted a search. The search yielded the victim's stolen property to include his Taurus handgun (concealed in the attic). The Taurus handgun matched the description the three victims provided when describing the gun Neil Herron had pointed at them. Herron immediately refused to answer any questions with regards to the investigation. Austin provided a post Miranda confession to participating in the burglary and to being in possession of the victim's stolen laptop. In addition, Austin confessed to being in possession of burglary tools and to helping Herron hide the stolen handgun in the attic of his home.

Neil Herron was transported to ORJ Central Booking and charged with Armed Burglary of a Dwelling, Grand Theft Firearm, Grand Theft ($300-$5,000) and Aggravated Assault (X3).

Anthony Austin was transported to the JAC and charged with Armed Burglary of a Dwelling, Grand Theft Firearm, Grand Theft ($300-$5,000) and Possession of Burglary Tools (crow bar/gloves).
