    Aggravated Battery

    Details:

    On February 6, 2016 at 1:54 pm, victims were waiting behind the Chevron Gas Station for the delivery of marijuana. The deal with a person the victim knew from high school named "Bam".   A black Chevy Monte Carlo arrived, and the occupants asked to see money.  The victim approached the car, displaying cash.  Bam snatched the cash out of his hands, and the car began to drive away.  The victim dove into the passenger side window, in an attempt to get his money back.  Bam began to punch him in his face.  Bam's brother pulled a firearm, shooting the victim in the abdomen several times.  The victim fell from the car, into the roadway.  He was taken to St Joes Main and found to have five wounds from the gun shots.  The event was captured on surveillance video.  

    Deputies began to search the area, finding the Monte Carlo backed into a driveway.  The suspect, eventually identified as the shooter, James Vega Jr, was at the residence.  He initially denied any knowledge of the incident, with his step father providing an alibi.  The two also advised the Monte Carlo would not even run.  The Monte Carlo had several distinct markings, which were captured on the video surveillance.  They agreed to checking the functionality of the Monte Carlo, which started with no problem.  Consent was gained to search the home.  Among James' belongings, three 9mm rounds were found.  James was confronted with all of the facts, at which time he provided a complete confession.  He further explained that during the incident, he accidentally shot his brother, Ivan Vazquez (Bam) in the hand.  This fact was not yet known by investigators. 

    He stated that Ivan was taken to an unknown hospital by his mother.  It was discovered that Ivan and his mother were at St Joes South, under a false name.  They claimed Ivan was shot in the hand, in the Brandon area, by an unknown black male.  Prior to be confronted, Ivan's mother approached deputies and told them she had been lying to the hospital staff.  She later gave an accurate statement.  Ivan also gave a post Miranda confession. James took detectives to a location he claimed to have discarded the firearm.  It was not located.  Both brothers were arrested and charged with armed robbery and aggravated battery with a firearm.
