Charges - Felony Illegal Dumping
In the month of December, 2016, two anonymous complaints of illegal dumping were received regarding property at 10716 Broadway Avenue in Tampa. The complainants stated there has been dumping at the site for about six months.
During the course of the investigation, detectives conducted surveillance at the location and learned American Waste Services brought in 40 yard dumpsters onto the property and dumped debris on 39 occasions.
On January 04, 2017, detectives initiated a traffic stop on a truck pulling out of 10716 Broadway Avenue that was hauling an empty waste roll off. The driver was identified and through interviews they identified Robert Rogan the owner of American Waste Services and Payless Waste Services. Further investigation revealed Rogan made a deal to bring the debris onto the property for $100.00 a load, and the debris would later be burned.
Detectives and representatives with the EPC responded to the Broadway location and met the property owners and issued a cease and desist order. Rogan agreed to remove the trash from the site.
Detectives met with prosecutors with the Hillsborough County State Attorney's Office to review their findings and a decision was made by the SAO to not file charges until the site was clean due to speedy trial concerns and that Rogan may cease the clean up. If the clean up was to cease the county would need a court order to enter the private property for the clean up which would cost in excess of $250,000.00.
On February 14, 2017, detectives and investigators with Hillsborough County Code Enforcement went back out to the site to check the status of the clean up. The area was not clean and no discernible progress had been made. Detective met again with the SAO to review the final list of charges and take action. The SAO authorized detectives to move forward and filing the charges and make an arrest for illegal commercial dumping, which is a felony with additional charges pending. Rogan was on felony probation for grand theft. HCSO was assisted with this investigation by the EPC, the Hillsborough County Health Department, Hillsborough Code Enforcement, and Hillsborough County Mosquito Control since the beginning of his investigation. Each of those agencies have opened their own investigations into the matter. Rogan was booked in the Hillsborough County Jail where he is being held without bail.
